How to Get Court Records
Begin with the court named on any notice, pleading, or cause number you have. The Brazos County Judicial Records Search is also known as Justice Web. It offers Smart Search for cases and judgments. Its Search Hearings tool covers settings only, not full files. Note the portal's own warning. Most documents have not been posted there since September 1, 2019. Probable-cause statements are treated differently. A hit is a locator. It does not mean every pleading in the court file can be downloaded.
District civil, family, juvenile, felony, and district action records sit with the District Clerk. County-level civil, probate, guardianship, mental-health, condemnation, and some JP appeal records may belong to the County Clerk. Each JP clerk keeps that precinct's civil, eviction, small-claims, traffic, and fine-only Class C files. Bryan and College Station municipal clerks hold their own city cases.
- Identify the court and cause or record number.
- Check Justice Web for the case, judgment, or hearing.
- Ask the responsible clerk whether inspection or a copy is available.
- Submit the form online, by mail, fax, email, phone inquiry, or at the counter.
- Choose pickup, U.S. mail, or on-site inspection.
- Call before paying when the custodian or fee is unclear.
Brazos Court Record Custodians
One courthouse, several counters. The District Clerk works out of Suites 1200/1201 at 300 E 26th Street in Bryan. That office answers at (979) 361-4230. The County Clerk sits in Suite 1430. Reach that office at (979) 361-4128 or by fax at (979) 361-4125. Both offices keep weekday hours of 8:00 a.m. to 4:30 p.m. Room assignments can shift, so confirm your destination before making the trip.
| Record | Starting custodian |
|---|---|
| District civil, family, juvenile, felony | District Clerk |
| County civil, probate, guardianship | County Clerk or named court |
| Small claims, eviction, JP traffic | Precinct JP clerk |
| City Class C or ordinance case | Municipal clerk |
| Deed or official land record | County Clerk official-records search |
County Court at Law 2 shows the split clearly. Probate, guardianship, eviction, condemnation, and JP appeals route to the County Clerk. Divorce, custody, other civil matters, and Class B or higher misdemeanors go to the District Clerk instead.
Types of Court Records
A docket is a dated list of actions in a case. The case file holds the documents behind those entries. On the District Clerk request form, you can name what you want. Ask for the entire case, the final judgment, the indictment, or another named item. A narrow request usually costs less. It also lowers the odds of getting the wrong file. Keep meanings straight. An indictment charges, but it does not convict. A judgment is the court's order or result. A hearing is just a scheduled event, not a result.
Justice Web splits cases, judgments, and hearings apart. Smart Search takes a record number or a name in Last, First Middle Suffix format. Advanced filters narrow by case type, status, filing dates, judicial officer, judgment type, and judgment dates. Search Hearings adds location, hearing type, courtroom, officer, and date-range fields. Each screen describes a different record object.
Brazos Historic Record Finding Aids
Older Brazos County court records are not organized the way portal fields are. The District Clerk historical index groups them by series and year instead.
Find the index or minute reference first. Then ask the clerk what copy or certification can be produced from it.
The series run deep. Civil Minutes stretch from the 1800s through 2000. Criminal Minutes run from 1874 through 1999, and Criminal Fee Books cover 1986 through 2001. There is a Divorce Index from 1965 through 2000. Divorce Minutes run from 1897 through 1973. These are finding aids, not substitutes for a complete or certified file.
What a Court Record Contains
What a record contains depends on the court and what you ask for. Compare enough fields to avoid matching the wrong case. A shared name alone will not cut it. Use the record number when you have it, and ask the clerk to confirm the item.
| Cause or record number | Court-assigned identifier used to narrow a request. |
|---|---|
| Case and court | Case type, assigned court, status, and filing date when displayed. |
| Parties | Names or roles subject to privacy limits and redaction. |
| Docket events | Filed items, settings, orders, and recorded case activity. |
| Judgment | A separate order or result, with type and date when indexed. |
| Documents | Pleadings or orders that may require a clerk request. |
A hearing result does not prove a judgment exists. In the same way, a case index does not promise that every filing is public or downloadable.
Narrow a Brazos Records Request
The printable District Clerk Public Information Request Form asks for your contact information and delivery preference. It also wants the full name to search. Include a date within five years. Give a date of birth when appropriate and any alias. Extra identifiers of that kind help the clerk. You may attach a list of names or case numbers. Routine criminal and civil searches cover 1992 to present unless you specify a different range.
Name the court, cause number, document title, and date range in your request. Ask for inspection if viewing the file will answer your question. Otherwise request the exact judgment, indictment, or filing you need. Two cautions from the form itself. It and the data you supply become public records. Processing starts only when payment arrives. No fixed turnaround time is promised.
A search fee is not a full file. It pays for the requested search. Copy pages and certification are separate outputs with separate charges.
Certified Copies and Fees
A plain copy just reproduces the record. A certified copy carries the clerk's authentication. Before sending money, check the District Court fee page, which is more detailed than the summary on the form. Cash is accepted in person only; checks and money orders also work. Mail and fax are documented ways to submit.
| District Clerk item | Listed fee | Use |
|---|---|---|
| Record search | $5 | Search request, not a complete-file guarantee |
| Regular or electronic copy | $1 per page | Plain reproduction |
| Certification | $5 plus $1 per page | Authenticated copy |

A court balance is a separate transaction. Never route a record-request payment through a collections channel without confirmation from the clerk.
Brazos Search, Copy, or Certify
Pick the right term before you ask a Brazos County clerk for anything. A search just finds likely docket entries. Inspection lets you view what the office makes available. A copy reproduces the pages. Certification adds an official attestation to them. Say which output you want. A Justice Web hit on a case number rarely includes every attachment in the court record.
- Inspection
- Review of an available record, including on-site inspection selected on the form.
- Redaction
- Removal or masking of protected information before release.
- Certified copy
- A copy authenticated by the record custodian for the listed charge.
- Sealing
- A restriction on public access imposed by law or court order.
Getting referred elsewhere is not bad news. A Brazos County record may simply sit with a different clerk, so the file still exists.
Public Access and Sealed Records
Texas court records are not ordinary agency files. Government Code chapter 552 points judicial records toward Supreme Court rules and other law instead. Texas Rule of Judicial Administration 12 sets out who may see judicial records, lists exclusions, and offers a review process.
Key Texas rules:
Rule 21c requires protection of sensitive information in filed documents.
Rule 76a governs sealing of court records.
Family Code chapter 58 provides confidentiality and sealing rules for juvenile records.
A custodian has choices when a request arrives. The office may release an index, permit inspection, redact protected data, refer you to another clerk, or deny part of the court record under a governing rule. Juvenile, sealed, and sensitive family material stays off limits, so never assume a case name or event makes it public.
When Brazos Forms Fail
A Brazos County form or PDF will not load? Try the county forms index. You can also call the office listed, or ask for the current version by email or fax. For documents after the 2019 Justice Web boundary, contact the custodian directly. Older files go faster when you give the historical series and the year. Need a court date instead of a document? Use Search Hearings or the court's own docket, then confirm any changes with that court.
Keep your request and fee notice on hand. Ask which office takes payment, whether a page estimate exists, and whether certification is required. That keeps records charges separate from the county Collections office's payment channels.
